Toyota have said they will not appeal the penalty which deprived Jarno Trulli of a place on the podium in the season-opening Australian Grand Prix.
The decision means that the third place earned by world champion Lewis Hamilton in Melbourne will stand.
In a statement published on Wednesday, Toyota said that, after referring to both recent rulings by the FIA’s International Court of Appeal and F1’s sporting code, they believed any appeal would be rejected.
The Italian crossed the line third in Melbourne but was given a 25-second penalty by race stewards, which saw him drop down to 12th position.
“Having considered recent judgements of the International Court of Appeal, it is believed any appeal will be rejected,” said a Toyota statement.
Toyota believe a procedural point would prevent any appeal from being successful, pointing to article 152, paragraph 5 of the sporting code, which says “Penalties of driving through or stopping in pit lanes together with certain penalties specified in FIA Championship regulations where this is expressly stated, are not susceptible to appeal.”
“Based on this Toyota Motorsport has decided it would serve no benefit to pursue this course of action,” continued the team statement.
