Open-wheel driver Paul Tracy claims former team owner Gerald Forsythe owes him money and he’s taking him to court over it.
Tracy, who has competed in both IndyCar and Champ Car events over the last decade, filed suit in U.S. District court, claiming Forsythe owes him more than $2.3 million.
The 39-year old Tracy’s lawsuit claims breach of contract on the part of Forsythe. Tracy had a $1 million buyout in his contract in case the team ceased operation.
The lawsuit, filed last week, claims former Champ Car team owner Forsythe breached his contract with Tracy, who signed a two-year deal in 2002 and had it extended twice, the last time through 2011.
Champ Car went out of business in February, with most of its teams absorbed into the rival Indy Racing League’s IndyCar Series. Forsythe decided to continue only in the second-tier Atlantic series rather than move his team to the IRL.
The 39-year-old Tracy was left without a full-time ride and has driven only two races this season - the Champ Car finale at Long Beach in April and the IndyCar race at Edmonton in July.
No date has been set for the lawsuit and Forsythe has yet to respond to allegations.
“Forsythe has, since at least late 2007, engaged in a pattern of conduct to injure .. the career of Paul Tracy in the sport of automobile racing”, claims the lawsuit.
The lawsuit claims a Termination Fee would be “payable in the event that Champ Car dissolved and Forsythe Racing chose to cease operations rather than race in an equivalent series”.
