According to maxchevy, the only sticking point so far is the operational control aspect of having 51%. This seems logical because Dale Junior has made it clear that he wants 51% because he wants “control” but having 51% does not give him control unless there is a corporate agreement that allocates voting shares according to ownership.
Theoretically, if Junior got 51% and Teresa got 49% Junior would have total control because there are just two people voting. But the report circulating says Teresa “is requesting that an independent, impartial review board be set up within DEI that would take into consideration and review any major operational changes that Dale Jr. would want to take place – acting like a board of directors. ” Apparently, this is the sticking point in the negotiations and would clarify why Dale’s sister said she did not care if the their piece of ownership was 51%.
