Following a CAMS Appeal Tribunal hearing held earlier this month concerning Aussie Racing Cars competitor, Mr Phil Ward, the Tribunal reconvened in Melbourne last night to hand down its decision.
The appeal related to an off track incident at Round 5 of the 2007 Aussie Racing Cars Series at Oran Park Raceway in which the Stewards found that Mr Ward was in breach of NCR 183 parts (viii) failing to obey the directions of CAMS or an official, (x) using or offering violence by any means towards any person, and (xii) any act prejudicial to the interests of motor sport generally. The Stewards imposed a penalty of a $30,000 fine and exclusion from the meeting.
After hearing submissions and reviewing the evidence presented at the initial appeal hearing into this matter on the 6th of September, the Tribunal’s decision handed down last night affirmed the penalty of a $30,000 fine, $10,000 of which is to be suspended for a period of 12 months.
In delivering its findings, the Tribunal reinforced the serious nature of these rule breaches in that they have a strong ability to bring motor sport into disrepute and that such acts will not be tolerated. The Tribunal also noted Mr Ward’s genuine regret for the incident and his subsequent apology to the relevant parties.
The Tribunal was chaired by Mr Lex Lasry QC together with tribunal members Mr Garth Wigston and Mr Robert Dyer.
